Arcmii Terms of Service

These Terms of Service (the “Terms”) govern use of “Arcmii” (the “App”), a schedule and time-management app for children and families provided by uh-creations (“we” or “us”). Users must agree to these Terms. A parent or guardian must review, consent to, and supervise use by a child.

1. Scope

These Terms apply to the relationship between users and us concerning the App. Notices and guidelines in the App also form part of these Terms.

2. Environment and accounts

The App can be used without account registration. Users are responsible for providing a supported operating system, device, network connection, and required permissions. Some features may be unavailable because of device or operating-system specifications.

3. Paid features and payment

In addition to a free plan, the App offers monthly and yearly auto-renewing subscriptions and a lifetime purchase. The price and any trial period are shown on the Apple App Store or Google Play confirmation screen. Subscriptions renew unless canceled through the store before the end of the current period. The lifetime purchase does not renew, and purchasing it does not automatically cancel an existing subscription.

Deleting the App does not automatically cancel a purchase or subscription. Refund eligibility and procedures are governed by the applicable store's terms, refund policy, and applicable law.

4. Prohibited conduct

• Violating law or public policy
• Unauthorized copying, modification, analysis, redistribution, or sale of the App or delivered content
• Exploiting defects or purchase functions to obtain unauthorized access
• Interfering with the App, delivery infrastructure, or a third party
• Infringing the rights or interests of another person
• Other conduct we reasonably determine to be inappropriate

5. Intellectual property

Rights in the App, design, software, and content we provide belong to us or the lawful rights holders. Rights in photos, text, or other material that users add themselves remain with the user or original rights holder.

6. Changes, suspension, or termination

We may change, suspend, or terminate the App or any feature for maintenance, failures, legal compliance, delivery needs, or another reasonable cause. When practicable, we will provide advance notice of a material impact.

7. Disclaimer and limitation of liability

We do not warrant completeness, accuracy, fitness for a particular purpose, uninterrupted availability, or perfect preservation of data. Users should maintain any necessary backups.

Except for our willful misconduct or gross negligence, or where exclusion is not permitted by law, we are not liable for indirect, special, or consequential loss, lost profits, or loss of data related to the App. If we are liable for ordinary negligence, liability is limited to direct and ordinary damages actually incurred and is capped at the amount the user actually paid for the App during the 12 months before the event. This limitation does not apply where prohibited by consumer-protection or other applicable law.

8. Changes to these Terms

We may revise these Terms for changes in law, features, or other necessity. Material changes will be clearly announced in the App or on our website before they take effect.

9. Governing law and jurisdiction

These Terms are governed by Japanese law. To the extent permitted by law, a court having jurisdiction over our location will be the agreed court of first instance for disputes related to the App.
